The FunnelSender software (the “Software”) is a technical tool intended to assist users in managing and sending electronic communications. FunnelSender does not provide legal, regulatory, or compliance advice.
Use of the Software does not guarantee compliance with any applicable laws, regulations, or industry standards. Users are solely responsible for ensuring that their activities comply with all applicable legal and regulatory requirements.
Email Marketing Compliance
Users of the Software are solely responsible for compliance with all applicable email marketing and electronic communications laws, including but not limited to:
• CAN-SPAM Act (United States)
• GDPR and ePrivacy Directive / PECR (European Union and United Kingdom)
• CASL (Canada)
• Any other applicable local or international laws
This includes, without limitation, responsibility for:

FunnelSender does not verify, monitor, or validate recipient consent, mailing list legality, or campaign content.

Users are solely responsible for compliance with all applicable data protection and privacy laws, including but not limited to:
• GDPR
• UK GDPR
• CCPA / CPRA
• Any other applicable data protection regulations
This includes responsibility for:
• Lawful collection and processing of personal data
• Maintaining appropriate privacy notices and policies
• Implementing adequate security safeguards
• Responding to data subject requests
• Ensuring lawful cross-border data transfers
FunnelSender acts solely as a software provider and does not assume responsibility for user-controlled data processing activities.
No Monitoring or Legal Review
FunnelSender does not monitor, audit, or review user content, recipient data, campaigns, or compliance practices.
The availability of the Software does not imply approval, endorsement, or validation of any user activity.
Third-Party Platforms
Users are responsible for complying with the policies and terms of any third-party platforms, email service providers, ISPs, or hosting services used in connection with the Software.
FunnelSender is not responsible for account suspensions, deliverability issues, blacklisting, or penalties imposed by third parties.
Indemnification
You agree to indemnify and hold harmless FunnelSender from any claims, penalties, damages, losses, or expenses arising out of or related to your failure to comply with applicable email marketing or data protection laws.
Limitation of Liability
To the maximum extent permitted by law, FunnelSender shall not be liable for any fines, penalties, regulatory actions, or damages resulting from user non-compliance with applicable laws or regulations.
