Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of funnelsender.com (the “Website”), the FunnelSender software, and any related services (collectively, the “Services”).
By accessing the Website, purchasing a license, downloading, installing, or using the FunnelSender software, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.
Definitions
“FunnelSender,” “we,” “our,” or “us” refers to the operators of funnelsender.com.
“User,” “you,” or “your” refers to any individual or entity accessing or using the Services.
“Software” refers to the FunnelSender executable application and related components.
“License” refers to a limited, non-exclusive, non-transferable, revocable right to use the Software.
License Grant
Subject to payment and compliance with these Terms, FunnelSender grants you a limited, non-exclusive, non-transferable license to use the Software on one (1) device only for a period of one (1) year from the date of activation, unless otherwise stated at purchase.
This License is for personal or business use only and may not be shared, resold, sublicensed, or transferred.
License Restrictions
You may not:
• Install or activate the Software on more than one device
• Share, resell, sublicense, or distribute the License
• Circumvent license validation or activation mechanisms
• Reverse engineer, decompile, or modify the Software
• Use the Software for unlawful, abusive, or fraudulent activities
Violation of these restrictions may result in immediate license suspension or termination without refund.
License Enforcement
FunnelSender uses technical methods to enforce license limitations, including device identification and activation monitoring.
If multiple activations or unauthorized usage are detected, FunnelSender reserves the right to suspend or revoke the License.
License Term and Expiration
The License is valid for one (1) year from the activation date.
Upon expiration:
• The Software may stop functioning or revert to limited mode
• Continued use requires license renewal
FunnelSender is not obligated to provide updates or support for expired licenses.
Payments and Billing
All payments are processed securely through Stripe or PayPal.
By making a purchase, you authorize FunnelSender and its payment processors to charge the applicable fees.
FunnelSender does not store full payment card details.
Prices, taxes, and fees are displayed at checkout and may vary by jurisdiction.
Refund Policy
You are entitled to request a refund within fourteen (14) days from the date of purchase, provided that the refund request complies with the conditions outlined below.
Because FunnelSender is a digital software product with immediate license delivery, refunds within the 14-day period are subject to verification and may be denied if the Software has been activated, used in violation of the license terms, or abused.
To request a refund, you must contact FunnelSender support at support@funnelsender.com within the 14-day refund window and provide your purchase details.
Refund requests submitted after the 14-day period will not be accepted, except where required by applicable law.
FunnelSender reserves the right to refuse refunds in cases of suspected fraud, abuse, multiple activations, or violation of the one-device license restriction.
Initiating a chargeback or payment dispute without first contacting FunnelSender support may result in immediate license suspension or termination and forfeiture of refund eligibility.
Software Delivery
Upon successful payment, license details will be delivered electronically to the email address provided during checkout within seventy-two (72) hours.
You are responsible for maintaining access to your email and safeguarding your license credentials.
User Responsibilities
You agree to:
• Provide accurate and complete purchase information
• Keep license credentials confidential
• Ensure your device meets system requirements
• Comply with all applicable laws when using the Software
Intellectual Property
The Software, Website, trademarks, logos, and all related intellectual property are owned by or licensed to FunnelSender.
No ownership rights are transferred under these Terms.
Updates and Modifications
FunnelSender may provide updates, patches, or improvements at its discretion.
We reserve the right to modify or discontinue any feature or service without liability.
Termination
FunnelSender may suspend or terminate access to the Services and revoke licenses if:
• These Terms are violated
• Fraud or abuse is detected
• Payment disputes or chargebacks occur
Termination does not entitle you to a refund.
Disclaimer of Warranties
The Software is provided “as is” and “as available” without warranties of any kind, express or implied.
FunnelSender disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, FunnelSender shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, profits, or business interruption.
Total liability shall not exceed the amount paid for the License.
Indemnification
You agree to indemnify and hold harmless FunnelSender from any claims, damages, losses, or expenses arising from your misuse of the Software or violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles.
Changes to These Terms
FunnelSender reserves the right to modify these Terms at any time. Updated terms will be posted on the Website. Continued use of the Services constitutes acceptance of the revised Terms.
